Dear Mr. Ayub:  

I respond in two parts for clarity:

As an individual property owner who has appeared at the Council Subcommittee meetings twice and has met with the Mayor and Miles, and has provided them documentation:

The specific conversation with the Mayor and Miles was for there to be a Pedestrian Mall Act Straw vote for the city defined district.  That draft preliminary documentation was provided to the Mayor and Miles now many weeks ago without any response.  We are confident and have so advised them and the subcommittee that more than 50% of the property owners, the designated voters under the statute will vote “no”.  That is the proffer from our side.  The staff report apparently rejects this and now wants yet another staff generated survey.  That is not what was discussed.  

As DvP President my comments to your email are: 

Any involvement of the DVP must proceed through the DVP process which would include presumably a presentation with documentation first to the appropriate committee and then to the Board where any decision making is vested.   So staff can make whatever requests it deems appropriate and then that presumably comes to me, it is then transferred to appropriate committee(s) for input/review, and then to the Board with committee input and/or recommendation.  You know this.  And so your staff report misleads council because it again drags DVP by name into the city process without even the courtesy of a phone call or heads up.  A proper wording would have been, for example:  staff will request in due course input from DVP once….. etc.     Your language implies that DVP has already bought on to yet another survey and again, to emphasize, that’s not my call, it is a Board decision in due course should it unfold.
